1. Company Information

Everisium is a web solutions provider based in Oregon, USA, specializing in web design, development, hosting, maintenance, and e-commerce solutions.


2. Services Offered

Everisium provides:

  • Web Design and Development
  • Website Hosting and Maintenance
  • eCommerce Solutions

Support Levels:

  • Premium Partners: Ongoing priority support and special eCommerce pricing, detailed in individual contracts.
  • Basic Accounts: Monthly Subscription with Standard Customer Service

3. Payment Terms

Basic Accounts:

  • Monthly fees, with early pay discount on yearly payments
  • Payments must be made on time; a one-week grace period applies.

Premium Partners:

  • Pricing and terms specified in individual contracts

Grace Period and Pauses

Failure to pay within the one-week grace period will result in a pause of all account features. During the grace period, clients may download their total site backup. Backup data will be permanently deleted if payment is not received by the end of the grace period.


4. Refund Policy

Customers may request refunds on a pro-rated basis for unused time periods upon cancellation. Refunds are subject to company approval and may be denied at the sole discretion of Everisium.


5. Dispute Resolution

All disputes arising from or relating to these terms shall be resolved through binding arbitration. The arbitration will be conducted in accordance with the rules of a recognized arbitration body, and the proceedings shall take place in Oregon, USA.

Terms of Arbitration:

  • Both parties waive their right to pursue claims in court or participate in class actions.
  • The costs of arbitration will be shared equally unless determined otherwise by the arbitrator
  • The arbitrator’s decision will be final and enforceable in any court of competent jurisdiction

6. Client Responsibilities

Clients are responsible for:

  • Requesting Updates: Everisium will only perform updates that have been explicitly requested by the client.
  • Approving Updates: Clients must approve updates before implementation. Everisium is not liable for any updates the client intended but did not request or approve.

Update Timelines

Clients acknowledge that there may be some delays, depending on demand, between a request and it’s completion. While estimated timelines will be provided, these are not guaranteed. Everisium is not liable for any claims or guarantees made by the client based on estimated timelines.


7. Termination

  1. Termination by Client:
    • Clients may terminate their service agreement at any time by using the online customer portal or contacting our customer service. Refunds will be processed per the refund policy.
  2. Termination by Everisium:
    • Everisium may terminate the agreement if the client:
      • Fails to make payments within the grace period;
      • Violates these terms and conditions;
      • Engages in illegal or unethical use of Everisium’s services.
  3. Effect of Termination:
    • Upon termination, all services will cease;
    • Clients must download any site backups during the grace period. Backups will not be retained beyond this time;
    • Any unpaid fees or outstanding balances must be settled immediately.

8. Changes to Terms and Conditions

Everisium reserves the right to update or modify these terms and conditions at any time. Clients will be notified of significant changes via email or an announcement on our website.

Client Responsibility:

It is the client’s responsibility to review the updated terms and conditions. By continuing to use Everisium’s services after changes are made, the client agrees to be bound by the updated terms.
